Payment Information*
All credit cards are assigned to your account automatically and are used to pay for parts ordered through Stompgrip. It is the sole responsibility of the card holder to update all new card information, failure to do so may cause a delay in order processing. All card numbers are kept protected to ensure the privacy of the card holder. You may be required to supply only the last four digits of the card at the time of purchase. Orders that cannot be paid in full using the card on file due to insufficient funds, incorrect information, etc. may be delayed until payment is received. Stompgrip will make every attempt to contact the responsible party to collect payment.
Minimum Advertised Price*
In order to protect the Stompgrip brand as a premium offering and preserve the company’s reputation for providing customers with quality products, best in class support, and protect the company’s competitiveness in the marketplace and the image of its products, Stompgrip is unilaterally adopting a Minimum Advertised Price Policy (MAP Policy) for Stompgrip products. This Minimum Advertised Price Policy will apply to all distributors and retailers, including internet retailers, who resell Stompgrip products to end users located in the United States and becomes effective November 1, 2024.
The Stompgrip MAP Policy is being adopted for the benefit of all Resellers and will be uniformly enforced.
The Following Guidelines Define How This MAP Policy Shall Function
Stompgrip’s Manufacturer’s Suggested Retail Prices (“MSRP”) are listed on the company’s Website, which may be amended or adjusted by Stompgrip at any time in its sole discretion. Each advertisement of a product identified on Stompgrip’s Website that is below the price for that product on Stompgrip’s Website will be a violation of this MAP Policy. Stompgrip products not specifically identified on the Website are not subject to this MAP Policy.
This MAP Policy applies to all advertisement of MAP Products in any and all media, including, without limitation, flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, mail order catalogs, internet or similar electronic media including websites, forums, email newsletters, email solicitations, television, radio, and public signage. Such website features as “Click for price”, automated “bounce – back” pricing e-mails, pre-formatted e-mail responses, forms, automatic price display for any items prior to being placed in a customer’s shopping cart, and other similar features are considered to be communications initiated by the reseller (rather than by the customer) and this constitutes “advertising” under this MAP Policy. This MAP Policy also applies to any activity which Stompgrip determines, in its sole discretion, is designed or intended to circumvent the intent of this MAP Policy, such as solicitations for ‘group purchases’ and the like.
This MAP Policy is not applicable to any in-store advertising that is displayed only in the store and not distributed to any customer(s).
The inclusion in advertising of free or discounted products (whether made by Stompgrip or another manufacturer) with a product covered by this MAP Policy would be contrary to this MAP Policy if it has the effect of discounting the advertised price of the covered Stompgrip product below the MSRP.
This includes advertising an additional discount, coupon, gift card, or incentive (whether in the form of a product, special event, promotion, term of doing business or otherwise, including loyalty points or rewards that can be redeemed for cash or merchandise; collectively an “incentive”) if the cumulative effect of the advertisedprice and the incentive would be to reduce the advertised price of any Stompgrip product subject to this MAP Policy below the MSRP.
Stompgrip does not, however, object to the following categories of store-wide promotions or incentives:
If pricing is displayed, any strike-through or other alteration of the MSRP that is paired with a discount price below the MSRP is prohibited.
This MAP Policy applies only to advertised prices and does not apply to the price at which Stompgrip products are actually sold or offered for sale to an individual consumer. Resellers remain free to sell these products at any prices they choose.
This MAP Policy does not establish maximum advertised prices. All Resellers may offer Stompgrip products at any price in excess of the MSRP.
Internet auctions may not display or have reserved bid or other acceptable prices below the MSRP. Prices for Stompgrip products that are below the MSRP may not appear in any online search tool (e.g.: Google Shopper, Price Grabber, NextTag, etc.) where your website is linked as the source.
Note: Certain online sales strategies result in advertised pricing that is below MAP. In the case of “add to cart” or “click here to see our low price” strategies, for example, Google Checkout will advertise the last price paid. Therefore, when products are sold at prices below MAP, an advertising event occurs to the next consumer because they see the product and the “last price sold” without having to “add to cart”. This inadvertent advertising is not permitted and must be monitored by the Reseller or risk jeopardizing their Authorized Reseller status.
From time to time, Stompgrip may choose to offer special promotions on certain products. In such an event, we reserve the right to modify or suspend this MAP Policy in whole or in part by notifying all Resellers of the duration and nature of the change. Stompgrip further reserves the right to adjust the MSRP with respect to all or certain products at its sole discretion. Such changes shall apply equally to all Resellers.
This MAP Policy is solely within the discretion of Stompgrip and authority acting through David O’Connor, Map Policy Administrator. No other employee or sales representative of Stompgrip has any authority to discuss, modify or grant exceptions to this MAP Policy. Any representation or action by any other Stompgrip employee or sales representative purporting to discuss, modify or grant exceptions to this MAP Policy under this paragraph is unauthorized and invalid.
All questions about this MAP Policy should be in writing and directed via U.S. Mail to: David O’Connor, MAP Policy Administrator, Stompgrip, 15431 Chemical Lane, Huntington Beach, CA 92649, or via e-mail to oc@stompgrip.com, who will respond only in writing.
No oral communications about this MAP Policy are authorized. The MAP Policy Administrator shall be solely responsible for determining whether a violation of the policy has occurred, communicating decisions to Resellers regarding the policy, and receiving any communications regarding sanctions imposed under this MAP Policy.
Notice and Correction -If the Dealer sells Stompgrip products below MAP, and has not been given notice of the Stompgrip MAP Policy, Stompgrip Inc. shall make reasonable effort to notify them following detection of first violation, and dealer will have two days to correct it. Subsequent violations may incur sanctions as noted below without further notice from Stompgrip.
Sanctions for violation of this policy are, at minimum, as set out below.
1st Violation: Any violation that occurs two (2) or more days following first notice of MAP policy. If not corrected within two (2) days of receiving first violation notice, dealer's ordering contract with suppliers will be suspended and continued for a period of two (2) days following correction.
2nd Violation: Occurs as result of any second violation following correction of a first violation notice or by failure to comply within six (6) days of receiving first violation notice. Dealer's ordering contract with suppliers suspended for a period of thirty (30) calendar days following correction.
3rd Violation: Occurs as result any third violation following correction of a second violation notice or by failure to comply within ten (10) days of receiving first violation notice. Dealer's ordering contract with suppliers suspended for a minimum period of 3 months following correction.
4th Violation: Occurs as result any fourth violation following correction of a third violation notice or by failure to comply within 14 days of receiving the first violation notice. Dealer's ordering contract with suppliers suspended for a period of six (6) months following correction.
5th Violation: Occurs as result any fifth violation following correction of a fourth violation notice or by failure to comply within twenty-one (21) days of receiving first violation notice. Dealer's ordering contract with suppliers suspended for a period of one (1) year following correction, or indefinite termination at the sole discretion of Stompgrip, Inc.
Stompgrip reserves the right to impose more severe sanctions at its sole discretion if the MAP Administrator believes that is justified and necessary to enforce the policy.
Stompgrip need not provide prior notice or issue warnings before taking any action under this MAP Policy.
Intentional and/or repeated failure to abide by this MAP Policy will result in sanctions unilaterally imposed by Stompgrip and may include indefinite termination.
Distributors of Stompgrip products will supply a copy of this MAP Policy to any new or existing Reseller for their records.
This MAP Policy has been established by Stompgrip to help ensure the reputation of Stompgrip as a leading manufacturer of high-quality products and to protect the reputation of the Stompgrip name and the products offered by Stompgrip. This MAP Policy is also designed to avoid destructive intra-brand conflict that will ultimately prevent healthy competition in the marketplace and to ensure that dealers and distributors have the incentive and resources to invest in services for Stompgrip customers.
Terms & Conditions
Stompgrip reserves the right to refuse any applicant under which circumstances the applicant doesn't qualify as a motorcycle only business. All customers will be on COD terms or company credit card. Stompgrip will discontinue selling its products to any dealer who advertises prices on Stompgrip product below 15% off m.s.r.p. by clicking yes here you have agreed to be a person of good standing to represent the above named dealership and that you have entered into an agreement with Stompgrip. Dealer agrees to pay for all invoiced items received. Only dealerships with a public showroom / store front will be accepted. Please call if you are online business only for referral to other Stompgrip distributors.
By agreeing to this section you authorize Stompgrip to retain the above mentioned card information, or any card supplied to Stompgrip from a representative of above name dealership; on file and to be used for all future orders as payment
All purchase over the internet must be paid with a credit card. All orders that do not process due to payment or quantities on hand will be held until payment is made or the order can be filled, all others will be processed and go out on the respected day and arrive using DHL, UPS, USPS, or FedEx from California.
All products manufactured by Stompgrip are guaranteed against defects in material and workmanship. Defective products will be replaced or credit given at our option. Stompgrip makes no other warranty of any kind, expressed or implied. Stompgrip will not be held liable for any loss or damages incidental, direct or consequential from the use of, or inability to use, Stompgrip products. Use other than specified voids warranty. Any alterations to products or product mounting areas, also voids warranty. Non-Stompgrip products are guaranteed in accordance with the manufacturer's own terms of warranty.
Stompgrip products purchased directly from Stompgrip will be accepted for return provided a return authorization is obtained within 10 days of receipt of order. Please call our Sales Department at 714-894-9388 to receive a return authorization. No freight or restocking fee will be charged on returned goods found defective or not as ordered. Custom made sprockets will be accepted for return with the following fees: 428/420 Chain size - $22, 520, 525, 530 Chain size - 54 teeth and below: $25, 520, 525, 530 Chain size - 55 teeth and above: $42 - All other returnable items due to customer error will be charged a 20% restocking fee. Stompgrip Sales Department hours are 9:00am – 5:00pm PT. We make every attempt to same day ship all orders received during these hours. We DO NOT guarantee shipping and/or delivery dates on ground shipments. We WILL guarantee shipping dates on air shipments. If Stompgrip does not meet the air shipping date we will refund the shipping charges. If the freight carrier does not meet air ship delivery date Stompgrip will contact carrier and will request a refund. If the customer used their own freight account it will be up to the customer to seek a refund from freight carrier for delivery mishaps.
Motorcycle riding and racing is an inherently dangerous activity and mishaps in competition or otherwise can result in injury or death. Each participant in competition or otherwise must assume the responsibility to assess safety aspects of facilities, conditions and equipment, and must assume all risks of competition or otherwise.
We believe the contents and specifications of our catalog are correct. We assume no liability for any errors in listings, specifications, part numbers, prices or model applications. We reserve the right to change specifications, product descriptions, product quality, pricing and application at any time without notice and without further obligation. The reproduction of any material from our catalogs is forbidden without our written approval.
